This edition of the Munster Colloquia focused on Model Contract Clauses under the Data Act, with contributions from representatives of companies active in the field. Discussions centred on model contract terms as a legislative tool, including the Model Contract Terms (MCTs) for data sharing and Standard Contractual Clauses (SCCs) for cloud contracts, and explored whether — and how — such tools could be used effectively in the future. Claude has been a member of the European Commission’s expert group since October 2022, contributing directly to the development of the MCTs and SCCs.
Key conclusions from the Munster Colloquia:
- Chapter VI of the Data Act and the SCCs can act as an enabler for switching
- The MCTs can support the drafting of contracts for data sharing
- Potential conflicts with national laws may arise. While MCTs can facilitate fairness, they do not guarantee it, making ongoing monitoring necessary
