Beltug joins regular consultation platform with the DPA

Beltug has joined forces with federations Comeos, Agoria, VBO/FEB, Assuralia and Febelfin in a new consultation platform with the Belgian Data Protection Authority (DPA), creating a regular channel for dialogue between the Authority and the sector federations. For the DPA, the platform will serve as a sounding board; for the federations, it offers an opportunity to promote clearer guidance and more practical support for organisations.

20 / 05 / 26

The first meeting took place with Data Protection Authority (DPA) representatives Koen Gorissen, Chair of the Executive Committee and Director of the General Secretariat, and Alexandra Jaspar, Member of the Executive Committee and Director of the Authorisation and Advisory Service.

Enforcement and support

The discussions covered a broad range of policy and enforcement topics. These included:

  • How to better support companies: the DPA stressed the important role sector federations can play. Rather than focusing on individual questions, the DPA wants to strengthen general guidance.
  • Enforcement priorities are large-scale data processing and the processing of minors’ personal data
  • Focus of investigations: investigations should focus on the issues explicitly raised in a complaint, rather than automatically expanding into a broader review of a company’s overall data protection policy
  • Developments related to the designation of regulators
  • Ongoing work on DPOs and data breach notifications, including the Digital Omnibus

Updating DPA biometrics guidance

Participants also exchanged views on the issue of biometrics. Companies require a valid legal basis, but no new Belgian privacy legislation is expected in the short term, as the legislator is likely to await the outcome of the Digital Omnibus initiative.

In the meantime:

  • The federations have asked the DPA to update its guidance on biometrics (FR or NL).
  • Beltug will contribute practical examples of use cases to support this process.
  • Beltug will also update its guidance on retention periods, and will ask the advice of the DPA.
  • The participants agreed to meet three times per year, with the next consultation scheduled for September.
