Understanding the role of the Standard Contractual Clauses and addressing common questions

Under the Data Act, cloud providers must remove obstacles to effective cloud switching and comply with a range of obligations designed to facilitate portability and competition. As of January 2027, switching charges will disappear altogether. To support the implementation of these rules, the European Commission published its non-binding Standard Contractual Clauses (SCCs) that translate the Data Act’s requirements into practical contractual provisions covering switching, exit, termination, security and business continuity.

During this session, Claude Rapoport, Chairman of the Beltug Board and member of the European Commission’s expert group that developed the SCCs, dove into the practical challenges organisations face when preparing for cloud switching and exit under the Data Act.

The Data Act and Standard Contractual Clauses for switching providers

Drawing on the European Commission’s Standard Contractual Clauses (SCCs) and questions collected from business users, Claude Rapoport explored the practical challenges organisations face when preparing for cloud switching and exit under the Data Act.
