“More than other regulations, the Data Act intends to create new business opportunities” explains Claude Rapoport, Beltug President and member of the European Commission’s B2B Data Sharing and Cloud Computing expert group. While the act covers both cloud contracts and data sharing, in this online session we focused on Standard Contractual Clauses (SCCs) for cloud contracts. On 25 November, we will dedicate a session to data sharing.
We explored how to make the best use of the SCCs in conversations and negotiations with cloud providers. Claude set the scene for us, with an overview of the Data Act and the work of the expert group. Then we heard from DLA Piper on how to actually use the clauses. Finally, we took a deep dive into several key clauses with Smals, to explore best practices. Plus, BIPT (which was named in the government’s coalition agreement as the probable regulator for the Data Act) was available at the event to answer questions.
