Recommendations: ‘The protection of valuable information in the light of data exchanges’
Data is said to be more valuable than oil today, and it gains even more value when it can be shared and exchanged. Unfortunately, there have been incidents where data exchanges didn’t result in an outcome that was perceived as ‘positive’ by all partners… Beltug and Stibbe have drafted a 16-page Paper for our members with do’s and don’ts when participating in data-sharing ecosystems.

In February 2022, the European Commission released its proposal for a Data Act, which aims to harmonise rules on making data available and on stimulating its usage. However, the final regulation will take time.
In the meantime, Beltug has received several questions from members on how to protect their invaluable data when collaborating and sharing it with various partners. Data, it is clear, is vulnerable, including when companies engage in data sharing. Companies need strong protection mechanisms, some of which they can implement themselves.
To help our members, Beltug and Stibbe have drafted a Paper that shares guidelines on what to look at when negotiating data sharing agreements. This includes why protection is important, what legal protections are currently in force, and some sample contractual clauses that companies may adapt or draw inspiration from for their own data sharing contracts.
