Change is coming: as of 12 September, the Data Act has brought new rules that will reshape how businesses handle data access and sharing. It introduces new rights and obligations to make data access and use fairer and more transparent across industries, and unlocks new business potential by empowering users to request data from manufacturers and share it with third parties. But organisations still have many questions, including around certain concepts and legal provisions as well as implementation.

Following our October session on the Data Act and the Standard Contractual Clauses (SCCs) for cloud switching and exit, we turned our focus to the data sharing side of the legislation. Stibbe started us off with an overview of the Data Act and its data sharing provisions, along with potential opportunities and pitfalls. Then, we discovered TVH’s digital spinoff GemOne, and how it uses industrial data collected from smart machinery.
